Is The Condominium Fee Mandatory?

Yes. The condominium fee is mandatory and there is even specific legislation on the subject. Thus, according to item I of Article 1336 of the Civil Code, the joint owners are responsible for collaborating with the expenses of the administration of the condominium.

Therefore, the division of the condominium quota is carried out from the ideal fraction of the units. This equation can also be done through the equal division of values. The apportionment can still take place in a different way, as determined by the condominium agreement.

Types Of Condominium Fee

There are two types of condominium fee that are ordinary and extraordinary. The first refers to all the basic costs of the condominium, such as:

  • Water, gas, electricity and sewage in common areas;
  • Salaries, charges and social security contributions of condominium employees;
  • Maintenance of common areas, such as swimming pool and gym;
  • Repairs to collective electrical and hydraulic installations;
  • Maintenance and conservation of hydraulic, electrical and mechanical installations and equipment in common use;
  • Fire prevention equipment;
  • Replacement of the condominium reserve fund.

The extraordinary condominium fee is related to non-routine building maintenance expenses, such as:

  • Renovation works that affect the entire structure of the property;
  • Installation of lighting in the condominium area;
  • Labor and social security indemnities for the dismissal of condominium employees;
  • Installation of security, fire, telephone or leisure equipment;
  • Facade paintings;
  • Decoration and landscaping;
  • Constitution of the reserve fund.

It is noteworthy that Law 8.245/91, also known as the Tenancy Law, determines the payment of ordinary condominium fees to the tenant.

The Amount Of Fees

The value of the condominium fee is determined at the general meeting. Thus, any change in prices must go through a vote. If residents consider the condominium fee to be abusive, it is necessary to call an assembly to deal with the issue.

For this to happen, it will be necessary to prepare a petition signed by ¼ of the residents. Budget changes are made along with accountability.

This review is mandatory and, according to Art. 1348 of the Civil Code, must be carried out at least once a year, and this conduct is one of the duties of the trustee.
